Terms of sale
Version 2026-10-v2-draft
Article 1 – Identity of the seller
The webshop Fertilize-it at fertilize-it.be is run by:
- Alammax BV
- Westkapellestraat 370a, 8300 Knokke-Heist, Belgium
- Company number 0704.658.874, Register of Legal Entities (RPR) Ghent, Bruges division [Lawyer: confirm the RPR line (RPR Gent, afdeling Brugge).]
- VAT number BE0704.658.874
- Email: info@fertilize-it.be
- Phone: +32 477 52 40 98
In these terms, "we" and "us" mean Alammax BV.
Article 2 – Scope
These terms apply to every order placed on fertilize-it.be. You accept them when you order (see article 14 for the version that applies).
We sell to:
- consumers: natural persons buying for purposes outside their trade, business, craft or profession, with a delivery address in Belgium, the Netherlands, Luxembourg or France (mainland France and Corsica only, not the French overseas territories or Monaco).
We do not sell to businesses through the webshop. Ordering for a business? Email us at info@fertilize-it.be.
Some rules apply to consumers only, such as the right of withdrawal and the legal guarantee for consumers. Nothing in these terms limits the rights that consumers have under mandatory law.
[Lawyer: since 8 Oct 2026 the shop sells to private customers only (FEATURES.md); the business-customer rules (who we sell to, Peppol invoices, the liability limit and the Bruges courts) were removed from this draft. Confirm.]
Article 3 – Offers and prices
We describe and show our products as accurately as we can. Obvious mistakes in our offer, such as a clearly wrong price, do not bind us. If we only notice such a mistake after you have ordered, we contact you: you can then keep your order at the correct price or cancel it free of charge with a full refund.
All prices are in euro and include VAT. Shipping costs come on top of the product prices; you see them before checkout (see article 6).
You pay the price shown when you place your order; a later price change never affects an order already placed.
Our offers are valid while stocks last. Special offers are valid only for the period stated on the website and do not apply automatically to later orders.
Article 4 – Ordering and conclusion of the contract
You order as a guest, without a customer account. Before you confirm, you see an overview of your order with the total price including VAT and shipping costs, and you can correct any input errors.
The contract is concluded when your payment is confirmed. If the payment fails or is cancelled, no contract is concluded.
You then receive an order confirmation by email, with these terms of sale and the model withdrawal form attached as PDF files. Keep this email: it is your record of the contract.
An order may weigh at most 30 kg. For larger orders, or if you would like to collect your order, please email us at info@fertilize-it.be.
Article 5 – Payment
You pay when you place your order, through our payment service provider Mollie. You can pay with Bancontact, KBC/CBC, Belfius, credit card, Apple Pay or iDEAL | Wero. We never receive your card details.
You receive your invoice by email through our invoicing service Billit.
The products remain our property until you have paid the full price.
Article 6 – Delivery and shipping
We deliver in Belgium, the Netherlands, Luxembourg and France (mainland France and Corsica only), to the delivery address you give when you order.
We pack your order ourselves and send it by standard delivery through MyParcel, with bpost, PostNL or DPD. Shipping costs depend on the weight of your order and the delivery country. Shipping is free from €85 of products in Belgium and from €125 of products in the Netherlands, Luxembourg and France. All details are on our shipping and returns page at fertilize-it.be/en/shipping-and-returns.
We ship your order within 1 to 2 working days after we receive your payment. Delivery time: delivery takes up to 7 days. Unless we agree otherwise, we deliver at the latest 30 days after the contract is concluded, and we tell you about any delay. If we do not deliver on time, you can give us a reasonable additional period; if we still do not deliver, you can terminate the contract and we refund all amounts paid without delay.
If a product you ordered turns out to be unavailable after all, we tell you as soon as possible and refund the amount paid for it without delay.
The risk of loss of or damage to the products passes to you only when you, or a third party you have designated who is not the carrier, take physical possession of them. Until then, loss or damage in transit is our risk.
Article 7 – Right of withdrawal
As a consumer, you can withdraw from the contract without giving any reason. The withdrawal period expires 14 calendar days after the day on which you, or a third party you have designated who is not the carrier, take physical possession of the products (for an order delivered in several parcels: the last parcel).
You can withdraw:
- online, with the "Withdraw from contract here" function at fertilize-it.be/en/withdraw, which is also linked in every email about your order;
- by email or by letter, with an unambiguous statement, for example using the model withdrawal form (this is optional).
Send the products back within 14 days after telling us about your withdrawal, to Alammax BV, Westkapellestraat 370a, 8300 Knokke-Heist, Belgium, unless we give you another address. You will have to bear the direct cost of returning the products.
We refund all payments received from you, including the original standard delivery cost, within 14 days after the day on which we are informed of your withdrawal. We may withhold the refund until we have received the products back or you have supplied proof of having sent them back. You are only liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
The full rules and the model withdrawal form are on our shipping and returns page at fertilize-it.be/en/shipping-and-returns.
Article 8 – Legal guarantee and complaints
Our products must conform to the contract. As a consumer, you have a legal guarantee of conformity of 2 years from delivery (Articles 1649bis to 1649nonies of the old Belgian Civil Code). If you live in the Netherlands, Luxembourg or France, you also keep the protection of the mandatory rules of your own country.
If a product does not conform, you are entitled to have it repaired or replaced free of charge or, if that is impossible, disproportionate or not done within a reasonable time, to a price reduction or to terminate the contract.
Please report a defect, including visible damage on delivery, as soon as possible after you notice it, by email with your order number and, if possible, photos. This helps us to solve the problem quickly and does not affect your legal rights.
Send complaints to info@fertilize-it.be; we answer as soon as possible and look for a solution with you. If we cannot agree, you can contact the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur), www.consumentenombudsdienst.be or www.mediationconsommateur.be.
[Lawyer: since 27 September 2026 the legal guarantee must also be shown prominently with the EU harmonised notice (Implementing Regulation (EU) 2025/1960; Article VI.45 of the Code of Economic Law). Confirm where the shop shows it and whether consumers in the Netherlands, Luxembourg or France need extra national wording.]
[Lawyer: FEATURES.md asks for a short section per country (Belgium, the Netherlands, France, Luxembourg) on the legal guarantee and the right of withdrawal: for the Netherlands no fixed 2-year term (conformity for the expected lifespan, Article 7:17 BW); for France the official model text of the legal guarantee box (Décret n° 2022-946, Code de la consommation Articles L.217-3 ff. and the commercial guarantee rules) reproduced word for word; for Luxembourg the Consumer Code wording. Please write these sections; the shop shows them as written here.]
[Lawyer: French consumers must be able to use a free consumer mediator (Code de la consommation Article L.612-1). Is the Belgian Consumer Mediation Service enough for them, or does the shop need a French mediator? If so, add its name and website here.]
Article 9 – Liability
We are liable in accordance with the law. Nothing in these terms excludes or limits our liability for intent, gross negligence, death or personal injury, or takes away rights that consumers have under mandatory law.
Use the products as instructed on the label and on the product page. We are not liable for damage caused by use contrary to those instructions, unless the damage is due to our own fault.
Article 10 – Force majeure
We are not liable if force majeure prevents or delays the performance of our obligations, meaning circumstances beyond our control that we could not reasonably foresee or avoid: strikes, fire, government measures, power, telecommunication or internet failures, or a failure of a supplier or carrier that is itself caused by force majeure. Our obligations are then suspended, and we inform you as soon as possible.
If force majeure makes performance impossible, or lasts so long that you cannot reasonably be expected to wait, you can terminate the contract and we refund what you paid for products not delivered. Force majeure does not affect your right of withdrawal.
Article 11 – Intellectual property
All intellectual property rights in the content of this website, such as texts, photos, images, logos and design, belong to Alammax BV, its suppliers or other right holders. You may not copy, change or distribute that content without our prior written permission, except for private use in connection with the products you buy.
Article 12 – Personal data
We process your personal data as described in our privacy policy at fertilize-it.be/en/privacy. How we use cookies is explained in our cookie policy at fertilize-it.be/en/cookies.
Article 13 – Applicable law and disputes
These terms and every contract with us are governed by Belgian law. If you are a consumer living in another country, you keep the protection of the mandatory provisions of the law of your country of residence.
Disputes with consumers go to the court that has jurisdiction under the law; we do not impose any particular court on consumers. You can also turn to the Consumer Mediation Service (see article 8).
Article 14 – Changes
We may change these terms. Each version has a version number and an effective date, shown at the top. The version you accepted when you placed your order applies to that order; it is also attached to your order confirmation. Changes only apply to orders placed after the new version has taken effect.
